This book addresses the fundamental ethical and legal aspects, penal consequences, and social context arising from a citizen's acceptance of guilt. The focus is upon sentencing people who have pleaded guilty; in short, post-adjudication, rather than issues arising from discussions in the pretrial phase of the criminal process. The vast majority of defendants across all common law jurisdictions plead guilty and as a result receive a reduced sentence. Concessions by a defendant attract more lenient State punishment in all western legal (...) systems. The concession is significant: At a stroke, a guilty plea relieves the State of the burden of proving the defendant's guilt beyond a reasonable doubt, and in open court. Plea-based sentencing has become even more visible in recent years. The book provides insightful commentary on the following questions: - If an individual voluntarily accepts guilt, should the State receive this plea without further investigation or any disinterested adjudication? - Is it ethically acceptable to allow suspects and defendants, to self-convict in this manner, without independent confirmation and evidence to support a conviction? - If it is acceptable, what is the appropriate State response to such offenders? - If the defendant is detained pretrial, the ability to secure release in return for a plea may be particularly enticing. Is it morally acceptable to use artificial intelligence (AI) in the form of computer-driven algorithms in the determination of sentences on those who have broken the law? If so, how should such algorithms be used? This book is the first collective work devoted exclusively to the ethical and penal theoretical considerations of the use of AI at sentencing. Most people assume that criminal offenders have only been convicted of a single crime. However, in reality almost half of offenders stand to be sentenced for more than one crime. The high proportion of multiple crime offenders poses a number of practical and theoretical challenges for the criminal justice system. For instance, how should courts punish multiple offenders relative to individuals who have been sentenced for a single crime? How should they be punished relative to each other? Predictive Sentencing addresses the role of risk assessment in contemporary sentencing practices. Predictive sentencing has become so deeply ingrained in Western criminal justice decision-making that despite early ethical discussions about selective incapacitation, it currently attracts little critique. Nor has it been subjected to a thorough normative and empirical scrutiny. This is problematic since much current policy and practice concerning risk predictions is inconsistent with mainstream theories of punishment. Moreover, predictive sentencing exacerbates discrimination and disparity in sentencing. Although structured risk assessments (...) may have replaced 'gut feelings', and have now been systematically implemented in Western justice systems, the fundamental issues and questions that surround the use of risk assessment instruments at sentencing remain unresolved. Much has been written about recidivist punishments, particularly within the area of criminology. However there is a notorious lack of penal philosophical reflection on this issue. This book attempts to fill that gap by presenting the philosopher’s view on this matter as a way of furthering the debate on recidivist punishments.

Notwithstanding diverse opinions and debates about mixing methods, mixed methods research (MMR) is increasingly being used in sport and exercise psychology. In this paper, we describe MMR trends within leading sport and exercise psychology journals and explore critical realism as a possible underpinning framework for conducting MMR. Our meta-study of recent empirical mixed methods studies published in 2017–2019 indicates that eight (36%) of the 22 MMR studies explicitly stated a paradigmatic position (five drew on pragmatism, two switched paradigms between qualitative (...) and quantitative elements of the study, and one was situated in relativist-interpretivism). The remaining 14 (64%) studies did not report their underpinning research philosophical assumptions. Evaluating the merits and limitations of these positions against critical realist assumptions suggests that several paradigmatic disagreements are potentially reconcilable. These include (a) maintaining that ontological and epistemological concerns are important for methodological integrity of a mixed methods study; (b) switching between paradigms in the same study is problematic; and (c) refuting the qualitative-quantitative incommensurability thesis, therefore allowing mixed methods research without compromising philosophical coherence. From a critical realist position, we suggest that both quantitative and qualitative designs are justifiable in a mixed methods study because (1) they help corroborate, refine, or refute plausible explanations of phenomena (epistemological), but (2) with different methodologies utilised to perform different tasks in the same research design related to different psycho-social system features (ontological). We call for a collaborative engagement by researchers across paradigmatic positions to work towards the advancement of methodological pluralism in our research community. (shrink)

Ted Shotter's founding of the London Medical Group 50 years ago in 1963 had several far reaching implications for medical ethics, as other papers in this issue indicate. Most significant for the joint authors of this short paper was his founding of the quarterly Journal of Medical Ethics in 1975, with Alastair Campbell as its first editor-in-chief. In 1980 Raanan Gillon began his 20-year editorship . Gillon was succeeded in 2001 by Julian Savulescu, followed by John Harris and Soren (...) Holm in 2004, with Julian Savulescu starting his second and current term in 2011. In 2000 an additional special edition of the JME, Medical Humanities , was published, under the founding joint editorship of Martyn Evans and David Greaves. In 2003 Jane Macnaughton succeeded David Greaves as joint editor. Deborah Kirklin, under whose auspices MH became an independent journal, took over in 2008, and she was succeeded in 2013 by Sue Eckstein. This short paper offers reminiscences and reflections from the two journals’ various editors.From the start the JME was committed to clearly expressed reasoned discussion of ethical issues arising from or related to medical practice and research. In particular, both Edward Shotter and Alastair Campbell, each a cleric , were at pains to make clear that the JME was not a religious journal and that it had no sort of partisan axe to grind.Campbell's appointment as founding editor was something of a surprise, as the original intention had been to appoint a medical doctor, who could be expected to know medical practice from the inside. However, in 1972 Campbell, a Joint Secretary of the Edinburgh Medical Group, had published Moral dilemmas in medicine. …. (shrink)

Background: Altering components of ecological momentary assessment measures to better suit the purposes of individual studies is a common and oftentimes necessary step. Though the inherent flexibility in EMA has its benefits, no resource exists to provide an overview of the variability in how convergent constructs and symptoms have been assessed in the past. The present study fills that gap by examining EMA measurement design for mood and anxiety symptomatology.Methods: Various search engines were used to identify 234 relevant studies. Items (...) administered, data collection schedules, response scales, data collection platforms, and psychometric properties were extracted.Results: Study designs varied greatly in all aspects across the identified papers. Over 4,600 extracted items were qualitatively analyzed, resulting in the identification of 12 themes. The most EMA items focused on affect, with categories such as “happiness” and “tension” appearing most frequently. We provide all of our data extraction in the format of an open-source database.Limitations: Despite our best attempts to include as much of the relevant literature as possible, this review and the accompanying database are not exhaustive, but can easily be built upon to include other, newer studies.Conclusions: The fact that the affect theme featured both positive and negative emotional constructs highlights the dichotomous focus on valence and affect within the literature surrounding anxious and depressive symptomatology. We hope that our database will act as a helpful design decision-making resource for researchers studying this kind of symptomatology in the future.Systematic Review Registration: PROSPERO. (shrink)

In the human sciences, experimental research is used to establish causal relationships. However, the extrapolation of these results to the target population can be problematic. To facilitate extrapolation, we propose to use the statistical technique Latent Class Regression Analysis in combination with the analogical reasoning theory for extrapolation. This statistical technique can identify latent classes that differ in the effect of X on Y. In order to extrapolate by means of analogical reasoning, one can characterize the latent classes by a (...) combination of features, and then compare these features to features of the target. Generative AI programs can produce high-quality written and visual content that may be used for good or ill. We argue that a credit–blame asymmetry arises for assigning responsibility for these outputs and discuss urgent ethical and policy implications focused on large-scale language models.

Given its non-invasive nature, there is increasing interest in the use of transcutaneous vagus nerve stimulation across basic, translational and clinical research. Contemporaneously, tVNS can be achieved by stimulating either the auricular branch or the cervical bundle of the vagus nerve, referred to as transcutaneous auricular vagus nerve stimulation and transcutaneous cervical VNS, respectively. In order to advance the field in a systematic manner, studies using these technologies need to adequately report sufficient methodological detail to enable comparison of results between (...) studies, replication of studies, as well as enhancing study participant safety. We systematically reviewed the existing tVNS literature to evaluate current reporting practices. Based on this review, and consensus among participating authors, we propose a set of minimal reporting items to guide future tVNS studies. The suggested items address specific technical aspects of the device and stimulation parameters. We also cover general recommendations including inclusion and exclusion criteria for participants, outcome parameters and the detailed reporting of side effects. Furthermore, we review strategies used to identify the optimal stimulation parameters for a given research setting and summarize ongoing developments in animal research with potential implications for the application of tVNS in humans. Finally, we discuss the potential of tVNS in future research as well as the associated challenges across several disciplines in research and clinical practice. (shrink)

This study examined patterns of auxiliary provision and omission for the auxiliaries BE and HAVE in a longitudinal data set from 11 children between the ages of two and three years. Four possible explanations for auxiliary omission—a lack of lexical knowledge, performance limitations in production, the Optional Infinitive hypothesis, and patterns of auxiliary use in the input—were examined. The data suggest that although none of these accounts provides a full explanation for the pattern of auxiliary use and nonuse observed in (...) children's early speech, integrating input-based and lexical learning-based accounts of early language acquisition within a constructivist approach appears to provide a possible framework in which to understand the patterns of auxiliary use found in the children's speech. The implications of these findings for models of children's early language acquisition are discussed. (shrink)

We describe the design and evaluation of a sub-clinical digital assessment tool that integrates digital biomarkers of depression. Based on three standard cognitive tasks on which people with depression have been known to perform differently than a control group, we iteratively designed a digital assessment tool that could be deployed outside of laboratory contexts, in uncontrolled home environments on computer systems with widely varying system characteristics. We conducted two online studies, in which participants used the assessment tool in their own (...) homes, and completed subjective questionnaires including the Patient Health Questionnaire —a standard self-report tool for assessing depression in clinical contexts. In a first study, we demonstrate that each task can be used in isolation to significantly predict PHQ-9 scores. In a second study, we replicate these results and further demonstrate that when used in combination, behavioral metrics from the three tasks significantly predicted PHQ-9 scores, even when taking into account demographic factors known to influence depression such as age and gender. A multiple regression model explained 34.4% of variance in PHQ-9 scores with behavioral metrics from each task providing unique and significant contributions to the prediction. (shrink)

Zusammenfassung Während der Fahrt der Flotte Alexanders durch den Indischen Ozean sichteten seine Seeleute angeblich ein Seeungeheuer. Die an der Unternehmung beteiligten Autoren Nearchos, Onesikritos und Orthagoras nahmen die ungewöhnliche Begegnung in ihre Werke auf, gaben diese aber in unterschiedlicher Weise wieder. Obwohl es sich dabei um eine in mehrerer Hinsicht interessante Episode handelt, besitzt sie einen besonders hohen Quellenwert, um Rückschlüsse über Alexanders Positionierung gegenüber den altorientalischen Kontexten seiner Herrschaft anzustellen. Schließlich behaupteten bereits die neuassyrischen Herrscher, auf dem Meer (...) am Rande der Welt Seeungeheuer gesichtet zu haben, womit ein allumfassender Herrschaftsanspruch einherging. Die achaimenidischen Großkönige benutzten dasselbe Argument, um Universalherrschaft und dadurch legitime Herrschaft zu kommunizieren. Kontextualisiert man die Sichtung des Seeungeheuers in den Fragmenten der Werke der Feldzugsteilnehmer in den Diskurs um Universalherrschaft des ersten Jahrtausends v. Chr., so lassen sich Alexanders Bestrebungen feststellen, sich zu den Konzepten legitimer Herrschaft nicht-makedonischer Prägung zu positionieren und sich in einer Weise als rechtmäßiger Herrscher zu präsentieren, die auch für seine asiatischen Untertanen verständlich war. Die am Alexanderzug teilnehmenden Autoren nahmen die hierfür benutzten Ideologeme in ihre Werke auf, passten sie aber entsprechend ihrer literarischen Absichten an. (shrink)

In his insightful review, Eugene V. Koonin discusses various aspects of CRISPR-Cas systems with a strong focus on their qualities as "adaptive immune systems". The CRISPR-Cas system is most famous for its application as a gene-editing tool. Koonin provides a deeper insight into its biological function in bacteria, which is to immunize the cell against parasite DNA. I shall comment on one issue discussed in the text, in two steps. First, I shall elaborate on CRISPR-Cas systems and their supposed Lamarckian (...) character. Criteria for calling biological phenomena genuinely Lamarckian will be narrowed down and then applied to the CRISPR-Cas system, considering interference-driven spacer acquisition as an instantiation of a truly Lamarckian paradigm. Second, I shall consider whether Lamarckian and "canonical" instances of inheritance are a case of theoretical pluralism, being two non-reducible, yet interconnected paradigms. (shrink)

Helix–loop–helix (HLH) genes encode for transcription factors affecting a whole variety of developmental programs, including neurogenesis. At least seven functional classes (denoted I to VII) of HLH genes exist,1 with subclass members exhibiting homo‐ and heterodimerisation for proper DNA binding and transcriptional regulation of downstream target genes. In the developing nervous system, members of class II, V and VI have been most extensively studied concerning their roles in neural programming. In contrast, the function of class I proteins (such as E12 (...) and E47) is poorly defined and the orthodox view relegates them to general dimerisation duties that are necessary for the activity of the other classes. However, closer scrutiny of the spatiotemporal expression patterns of class I factors, combined with recent biochemical evidence, would suggest that class I proteins possess specific functions during early neural differentiation. This essay supports this possibility, in addition to putting forward the hypothesis that, outside their general dimerisation activity, class I genes have independent roles in regulating neurogenesis. Most present day philosophers assume that chance or luck is morally relevant. That it makes a moral difference whether an action of mine has, by chance, good or bad consequences. I will defend the opposing view: There is no moral luck, luck is morally irrelevant. The examples which are taken to show that there is moral luck rest on conceptual confusions. The confusion between reasonable bad sentiments and moral responsibility (sec II), the confusion between ex ante rationality and ex post (...) assessment (sec III), the confusion between epistemic and normative assessment (sec IV), the confusion between ideological interpretation and moral judgement (sec V). The canonical account according to which action is intentional behaviour, that the agent controls and for that she is responsible, can be defended (sec VI) if one discriminates moral from other forms of responsibility (VII). Routinely obtaining consent for the different ways in which childbirth is commonly intervened on and the assistance involved (such as midwife-led care or a planned caesarean section) and providing sufficient information for women to evaluate the harms and benefits of the care on offer, would not only enable the empowerment of women but would align with the current (...) standard of care as established by Rogers v Whittaker. Sus amigos moderados desconocían esta circunstancia, y se prestaron a ayudarlo, hasta que una recensión de dos libros franceses publicada en la Gaceta de Madrid, denunciada primero por la prensa tradicionalista por heterodoxia, y luego por los Obispos de Barcelona y Zamora, permitió conocer su verdaderos planteamientos políticos y su anticlericalismo.

Summary The article examines unofficial imperial nicknames, sobriquets and appellatives, from Octavian Augustus to Julian the Apostate, in the light of traditions of Roman political humour, and argues that in the political field during the Principate there were two co-existing competing modes of emperors’ naming: along with an official one, politically loyal, formalised and institutionally legitimised, there existed another – unofficial, sometimes oppositional and even hostile towards individual emperors, frequently licentious, humorously coloured and, in this regard, deeply rooted in (...) Roman Republican traditions of political humour. Many of the known imperial nicknames and appellatives belong to a specific kind of folklore and express popular public opinion. They survived for us because of ancient authors’ interest in using such material for their literary and ideological intentions, particularly to express better the individual characteristics of the historical personages. But, for the very same purposes, Greek and Roman writers could invent some names and sobriquets, following special rhetorical and moralising principles, or mere love of ridicule. All in all, most imperial nicknames, both authentic and made-up, reveal a rather good quality of humour and mockery constructed by expressive linguistic devices and various rhetorical tropes. An apt derisive nickname marked anti-values, mocked the ruler’s badness and could vilify his reputation to the extreme, stigmatise his personality, or else become a widely-used quasi-cognomen. Many nicknames and appellatives were of ephemeral, ad hoc nature, their sense and effect largely dependent on the particular context; but, taken as a whole, they demonstrate the possible scope of and common trends in naming practice. The political system of the Principate and its very atmosphere of hypocrisy did promote double meaning and double thinking reflected in the double system of the rulers’ nomenclature. Imperial nicknames were a counter-hegemonic transcript and a weapon in the struggle for symbolic capital. All the efforts which many emperors took to control their nomina were ultimately powerless against the strength of the inevitable humorous counter-naming by the ruled. (shrink)

In previous Ethics briefings 1 we have highlighted the developments in the case of Bell & Another v the Tavistock and Portman NHS Foundation Trust. The case concerned a judicial review of the practice of prescribing puberty blocking treatment to children and young people at the Gender Identity Development Service managed by the Tavistock and Portman NHS Foundation Trust. The Court of Appeal in its judgement2 found the Trust’s practices to be lawful, and overturned previous guidance given by the High (...) Court which had contradicted the 'Gillick principle' regarding whether a child or young person could consent to medical treatment, without the consent of its parent. Despite this legal success, concerns over the GIDS continued. In September, NHS England commissioned an independent and wide-ranging review of gender identity services for children and young people led by Dr Hilary Cass, past president of the Royal College of Paediatrics and Child Health. Dr Cass’s Interim review, published in March,3 has resulted in a decision by NHS England to close the GIDS at the Trust by Spring 2023, and replace it with regional centres at existing children’s hospitals offering more 'holistic care' with ’strong links to mental health services’. It is proposed that regional centres will be established at Great Ormond Street Hospital, and Alder Hey Children’s NHS Foundation Trust. Dr Cass was critical of the clinic’s failure to collect sufficient data on the impact of puberty blockers in under-16s. …. (shrink)
